City Council Seeking Feedback on Convenience Cash Businesses

The Derby City Council is seeking feedback from citizens and business owners about the presence of convenience cash businesses in Derby.

Background
The Derby Planning recently recommended proposed restrictions on “Convenience Cash Businesses” such as payday loans, title loans and check cashing establishments as well as pawn shops. The main incentive for establishing the restrictions is to maintain property values in the area. Ensuring that such businesses are appropriately located in the City will help to avoid the negative secondary effects associated with the clustering of these businesses, including increased crime, a perception of blight in an area, and the creation of a disincentive for other businesses to locate in the same area.

The Planning Commission’s recommendations were developed after researching similar ordinances in Overland Park, Lenexa and Louisburg, Kansas and Gladstone, Missouri with additional information received from the League of Kansas Municipalities and Internet research.

The Planning Commission’s recommended restrictions are to require:

  • such business be located only in the B-4 Zoning District (generally along K-15 from Sunnydell Street north to Buckner),
  • a one-mile separation between similar businesses,
  • a 250-foot separation from residences, and
  • such business be located in a multi-tenant building

Possible modifications to the Planning Commission’s recommendations include: 1) reducing the separation distance to a shorter distance, say 1500 feet, 2) removing Pawn Shops from the regulations, if those pawn shops do not offer payday loans, and 3) allowing such businesses to be located in other business districts.

Feedback will be received through 9:00 a.m. on Tuesday, May 27. Provide your input on convenience cash businesses. Input will be shared with the City Council at its meeting at 7 p.m. on Tuesday, May 27. The meeting will be held at City Hall, 611 Mulberry Rd.
